By creating an account on OneTelemetry ("the Service"), you agree to be bound by these Terms of Use. If you are registering on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree, do not create an account or use the Service.
You must be at least 18 years old and capable of entering into a binding legal agreement to use the Service. The Service is intended for business and professional use.
You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
OneTelemetry provides infrastructure monitoring, alerting, and observability services including but not limited to: uptime checks (ICMP, TCP, HTTP, SSL, DNS, domain), metric collection via agents, dashboards, alerting, incident management, on-call scheduling, synthetic testing, and log management.
You may only monitor resources — including hosts, IP addresses, endpoints, domains, and SSL certificates — that you own or for which you have explicit, documented legal authorization to monitor. Unauthorized scanning, probing, or monitoring of third-party infrastructure is strictly prohibited and constitutes a material breach of these Terms. OneTelemetry reserves the right to immediately suspend or terminate your account without notice if unauthorized monitoring activity is detected. You agree to indemnify and hold OneTelemetry harmless from any claims, damages, or legal actions arising from your unauthorized monitoring of third-party resources.
You agree not to:
You retain ownership of all data you submit to the Service ("Your Data"). We collect and process Your Data solely to provide and improve the Service. We do not sell Your Data to third parties. Monitoring metrics, logs, and configuration data are stored within your organization's scope and are not accessible to other organizations. We implement industry-standard security measures to protect Your Data, but cannot guarantee absolute security.
Free accounts: Organizations on the free plan that have no active agents connected and no user login activity for 45 consecutive days will be considered inactive. Inactive organizations and all associated data — including users, checks, metrics, dashboards, alerts, and configurations — will be automatically and permanently deleted. Warning notifications will be sent to the registered email addresses at 15, 30, 40, and 44 days of inactivity. It is your responsibility to maintain account activity or export your data before the inactivity period expires.
Paid accounts: Paid subscriptions remain active as long as payments are current. If a payment is past due for more than 31 days, the account will be suspended — all monitoring checks and agent data collection will be stopped, and access to the Service will be restricted until the outstanding balance is resolved. If the account remains past due for more than 62 days, the organization and all associated data will be permanently deleted. Reinstatement after deletion is not possible.
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We may perform scheduled maintenance, during which the Service may be temporarily unavailable. Free-tier accounts are not covered by any service level agreement (SLA).
The Service, including its software, design, logos, and documentation, is the property of OneTelemetry and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, service marks, or trade names. Your use of the Service does not transfer any intellectual property rights to you.
Certain features of the Service may require a paid subscription. By subscribing, you agree to pay all fees in accordance with the pricing and billing terms presented at the time of purchase. Fees are non-refundable except as required by applicable law. We reserve the right to change pricing with reasonable notice.
To the maximum extent permitted by applicable law, OneTelemetry and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless OneTelemetry from and against any claims, liabilities, damages, losses, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your monitoring of resources you are not authorized to monitor.
You may terminate your account at any time by contacting us or deleting your organization. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our data retention policies.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice within the Service. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of New York.
